Privacy Policy

The short version: Our apps and websites do not sell your data, do not run ads, and do not build advertising profiles about you. Most app data stays on your device or in your personal iCloud account. We use Datadog to monitor the performance of our apps and of nearmiss.dev, which involves limited technical and usage data (and, on nearmiss.dev, cookies you have to accept first). Our haiku site uses Cloudflare Web Analytics instead, which sets no cookies at all. That's it.

The two websites do not have identical data practices — they are built on different infrastructure and use different analytics. Section 2 describes each one separately.

If a future app has materially different data practices, those will be described in a supplemental notice within that app. Otherwise, this policy applies by default.

2. Data We Collect and Why

Website analytics — nearmiss.dev, Datadog Real User Monitoring

nearmiss.dev uses Datadog Real User Monitoring (RUM) to understand how visitors use the site and to monitor its performance. This is off by default — when you first visit nearmiss.dev, a banner asks for your consent, and no analytics cookies or scripts load unless you select "Accept." If you consent, Datadog RUM may collect:

For a sample of visits (approximately 20%), we also enable Session Replay, which records a reconstruction of your interactions with the page — such as mouse movement, clicks, and scrolling — so we can diagnose usability and performance issues. Any text that could be entered on the page is masked and is not captured. This data is used solely to improve the website; it is never sold or used for advertising.

Withdrawing consent: If you decline, or later change your mind, no analytics data is collected. Your choice is remembered in your browser. To reset it and be asked again, clear this site's stored data in your browser settings; to opt out after previously accepting, do the same and select "Decline." Your web hosting provider may separately retain standard server access logs for infrastructure and security purposes regardless of this choice.

Website analytics — haiku.nearmiss.dev, Cloudflare Web Analytics

haiku.nearmiss.dev is a set of static files served by Cloudflare. It does not use Datadog, and it does not show a consent banner, because it uses Cloudflare Web Analytics — which sets no cookies and writes nothing to your browser's storage. There is nothing stored on your device for you to accept or decline. Cloudflare Web Analytics reports aggregate measurements such as:

What the haiku site does not have: there are no accounts, no logins, no comments, and no forms that send anything to us. The poems are generated on a schedule, not in response to anything you do, so nothing you do on the site influences what it publishes.

Search: the archive search runs entirely in your browser. The search index is downloaded once and matched locally on your device — your search terms are never sent to us as a query. Note, however, that the search box puts your terms in the page address (for example /search/?q=rain), and page addresses may appear in the standard server logs that Cloudflare keeps for infrastructure and security purposes.

Location data NearMiss

NearMiss requests access to your device's location in order to detect proximity to points of interest (POIs) that you have saved. Your location data is processed entirely on your device and is never transmitted to our servers or any third party. You can revoke location access at any time in iOS Settings.

App content you create

Data you enter into our apps — such as saved POIs in NearMiss, mileage logs in EmPGee, meditation session records in Akwaba, and game progress in CastleBomb — is stored locally on your device. If you have iCloud enabled for a given app, this data is synced to your personal iCloud account and is governed by Apple's Privacy Policy. NearMiss LLC has no access to your iCloud data.

Apple ID (for in-app purchases)

Some apps offer optional in-app purchases via the Apple App Store. When you make a purchase, Apple handles all payment processing. We receive a transaction receipt to verify the purchase. We do not receive, store, or process your Apple ID email address, name, or payment information.

Our apps and websites interact with the following third-party services. Each is governed by its own privacy policy.

5. Data Retention and Deletion

Data stored on your device is retained until you delete the app or clear its data via iOS Settings. iCloud data is retained in your personal iCloud account and can be deleted by you at any time.

Performance data sent to Datadog is retained in accordance with Datadog's retention policies. Because this data contains no personal identifiers, we cannot retrieve or delete specific records tied to you.

Analytics for haiku.nearmiss.dev are retained by Cloudflare in accordance with its retention policies. Because that data is aggregate and cookieless, there is no identifier that would let us — or Cloudflare — connect it back to you, which also means we cannot isolate or delete an individual visitor's records.

To delete all data associated with an app, simply delete the app from your device. For iCloud data, go to Settings → [your name] → iCloud → Manage Storage and delete the relevant app's data.

6. Children's Privacy

Our apps and websites are not directed to children under the age of 13. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will take steps to delete it.

7. Your Rights

Depending on where you live, you may have rights regarding your personal data, including the right to access, correct, or delete it. Because we collect very limited personal data and most of it resides on your own device or iCloud account, you can exercise most of these rights directly through iOS settings. For any other requests, please contact us.

8. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will update the effective date at the top of this page. For material changes, we will notify users through the app or App Store release notes. Continued use of our apps after a change constitutes acceptance of the updated policy.
